Terms and conditions

These terms and conditions form a legally binding agreement between you and ClickedbyNic Photography ("we" or "us") in relation to your use of this site and the products available on this site. You accept these terms and conditions by accessing or using any part of the site after you have first accessed a page providing a link to them.

All images and products are the property and copyright of ClickedbyNic Photography (in their respective year of production). All rights including the copyright remain with ClickedbyNic Photography unless otherwise granted. It is illegal to copy or use anything from this site without the express written permission of ClickedbyNic Photography.

If you purchase a print or a printed product from us you are granted a right to display the print or product in your personal surroundings. Copyright restrictions (see above) are fully applicable.

ClickedbyNic Photography warrants to provide products as described at the time of purchase. There may be minor variations between the completed product and a the way a product is described and/or pictured due to manufacturing changes at the time of production. The edges of images may be cropped differently to a frame, canvas or mount than what is depicted on this site.

The image quality of finished products received by customers will generally be of a higher quality than what is actually pictured on this site. Products pictured on this site are generally low-resolution versions of the actual product or image.

Larger prints and products are best viewed and appreciated at a reasonable viewing distance (ie from at least a metre or more) and are not intended for close-up viewing at less than this distance. The larger the product, the greater this distance will be. Images printed on textured surfaces, such as canvas, will naturally have visible grain and this is accentuated if viewed at close-range.

All prices are in Australian dollars and are inclusive of Goods and Services Tax (GST).

The pricing of any merchandise on this website is subject to change and is determined by the Owner.

Orders are only processed and despatched once payment in full has been confirmed. Payment is managed by third-party payment providers Stripe and PayPal. Interactions and transactions between the customer, Stripe and PayPal are the responsibility of the customer and Stripe and/or PayPal. ClickedbyNic Photography makes no warranty or undertakings on behalf of Stripe or PayPal.

Delivery options and fees are presented with each product at the time of purchase at the 'check out' stage, prior to payment.

All of my physical products include FREE SHIPPING in Australia.

Delivery services are generally provided by Australia Post, but may vary depending on the product/s purchased.

We reserve the right to review delivery fees for your order where your order exceeds the weight/size limit for your selected delivery option, and/or for international orders - depending on the destination country and location. If this is the case, we will advise you of the revised delivery fees before your order is further processed.

If you have ordered multiple items and we are able to provide a lower combined delivery fee to you, we will refund any overpayment to you.

On arrival, please check your items carefully as soon as possible, including the packaging. ClickedbyNic Photography takes no responsibility for damage to products during transit or while awaiting collection by you. If goods are damaged in transit it is the customers responsibility to seek a remedy from the delivery provider.

Insurance is provided only if and where indicated during purchase and payment on this website. If you require insurance please contact us to arrange this.

Delivery times are indicative only and may vary. ClickedbyNic Photography takes no responsibility for delivery times. However, should a product not arrive within a reasonable time period please contact us and we will initiate enquiries with the delivery agent and/or production laboratory (as applicable).

Returns are permitted where the item is not fit for purpose or has not been supplied as ordered. Please check carefully when purchasing as ClickedbyNic Photography takes no responsibility for customers misreading and/or misunderstanding product descriptions and/or these terms and conditions.

Digital image downloads are non-returnable and licence fees are non-refundable.

To return a product, please contact us within 7 days of receipt of the product. Arrangements for return can then be made. Requests for returns must be made within 7 days of receipt of the product. Requests for returns after 7 days will not be accepted.

The customer is fully responsible for all delivery costs to return the product. A returned product may be credited for the customer's use for purchasing other products, or may be refunded to the customer.

The customer is responsible to report and damage in transit to the delivery agent - according to the delivery agent's policies and procedures.

Delivery fees to the customer are not refundable.

Returns are subject to the consumer laws of Tasmania, Australia.

Each user agrees to indemnify ClickedbyNic Photography and any of its owners, directors, agents or employees against any claim for loss or damage of any kind by any third party arising out of, or in relation to, the use of the website or any products used or purchased through this website.

We are not liable to you or any person, agent or entity for damages, costs or losses stemming from any usage of this website, images, and products on this website.

Australian law applies in this regard. In brief, we have the right (as all photographers do) to make a photographic image of a person/s in a public place and display it on this website without permission.

We may publish an image of a specific person for sale on this website if that person is not clearly the single subject of the image and the person is not clearly identified; OR the person was photographed on the basis of any of the following exceptions:
