DIGITAL IMAGE PERSONAL USE LICENCE (no-fee, restricted rights)

The following terms and conditions apply when you obtain this licence...

ClickedbyNic Photography (hereafter referred to as “us” or “we”) grants this PERSONAL USE LICENCE to the purchaser (hereafter referred to as “you”) to make permitted personal and non-commercial uses of the associated electronic digital image purchased (hereafter referred to as “the image”), subject to all the following terms and conditions.

Copyright of this image and all other rights pertaining to this image remains with us.

A reference to "image" in this licence means part or all of the image.

YOU MAY USE THIS LICENCE ON CONDITION:
* you exercise these rights only for personal and non-commercial purposes and the image must not be used as a trademark and derivative works must not be commercially exploited in any form;
* you do not use or display the image in a commercial premises, website, publication or software application;
* you do not make electronic or printed copies accessible to other persons or entities, including as an extractable part of any electronic file;
* the 'clickedbynic photography' watermark on the image must not be removed or altered in any way;
* you do not use the work for derogatory or illegal purposes; and
* you do not otherwise infringe the copyright in the image.

THIS LICENCE IS:
* free - with no upfront or ongoing payments;
* worldwide - with no territorial restrictions;
* ongoing but revocable - continues indefinitely, but we may revoke it and will notify you if we do revoke it;
* non-exclusive - we can grant the same rights to others; and
* non-sub-licensable & non-assignable - you cannot grant or transfer your licence rights to any other person.

INDEMNITY

You indemnify and holds us harmless against all claims, liability, damages, costs and expenses stemming from a breach of this agreement, the use of the image, your failure to abide by any restriction regarding the use of an image, or any claim by a third party related to the use of the image.

WARRANTY AND LIABILITY
This image is provided "as is" with no warranty, expressed or implied, regarding the suitability of the image for any purpose. We are not liable to you or any person, agent or entity for damages, costs or losses stemming from any usage of this image.
